From the meeting of the association council on 28.11.2024


Mayor Rudolf Jacob invited the members of the Association Council to the last meeting of 2024 on Thursday, November 28, 2024, in the meeting room of the town hall.

First, the mayor announced an urgent decision regarding the purchase of a dishwasher to replace a machine for the Münchweiler daycare center that had broken down at short notice. The municipal council approved the mayor's urgent decision to order a new machine at a gross tender price of € 7,018.62 and to finance this expenditure above budget.

This was followed by the election of Mr. Christopher Reinhard, Kanalwerk, as employee representative on the Works Committee. This position was previously vacant.

Mayor Rudolf Jacob then welcomed Dr. Breitenbach from the auditing firm Burret, Ludwigshafen, who reported on the annual financial statements of the sewer plant, the waterworks and the outdoor pool for the 2023 financial year. Dr. Breitenbach discussed the economic developments over the course of the 2023 financial year and informed the audience that the sewer plant had recorded an annual loss of € 93,995.27. He put the annual loss at the waterworks at € 521,090.36. The loss affecting expenditure at the outdoor pool was put at € 807,839.83. This will be offset by the association municipality from general budget funds. The auditor answered questions on the respective annual financial statements directly. Mayor Rudolf Jacob pointed out that fees and contributions in the water and sewer works had been stable since 2016. Now that both companies have incurred corresponding annual losses and losses are also expected for 2024, a recalculation of the fees and charges will be presented in the first quarter of 2025. The municipal council would then have to decide on any necessary fee adjustments. The auditor then explained that the audit of the three annual financial statements had not revealed any objections. An unqualified audit certificate was issued. The members of the Works Committee recommended that the Association Municipal Council approve the 2023 annual financial statements as presented. This recommendation was followed unanimously by the Association Municipal Council.

This was followed by a discussion and resolution on the 2025 business plan for the sewer works. This closes with a planned annual loss of € 278,200.00. An annual loss of € 519,260.00 is calculated for the waterworks in 2025. An annual loss of € 790,637.00 is expected for the outdoor pool. The members of the Works Committee unanimously recommended that the Association Municipal Council adopt a resolution on the 2025 business plans presented, which the Association Municipal Council then unanimously approved accordingly.

This was followed by the announcement of the results of an unsuspected cash audit. Mayor Jacob explained that the association municipal council must be informed of the audit result of corresponding unsuspected supra-local audits by the district administration. He explained that such an unsuspected cash audit had taken place on 28 and 29 October 2024. This had not led to any objections.

Without further discussion, the municipal council unanimously decided to conclude a special-purpose agreement with Zidkor on the public-law operation of a central IT platform. This involves the legally compliant provision of data from the residents' registration office and the registry office in particular.

This was followed by the award of a total of 4 contracts for the extension and conversion of Sippersfeld elementary school. The respective trades had been put out to limited tender. The contract for the demolition work of the 3rd construction phase was unanimously awarded to the most favorable bidder, the company Gebrüder Baumgarten GmbH, Enkenbach/Alsenborn, at a gross bid price of €59,973.51. The gross cost estimate was € 60,300.00. The earthworks, drainage, bricklaying and concrete work was awarded to Kurt Mayer Bau GmbH & Co KG, Schopp, at a gross tender price of €44,517.31. The cost estimate here was €50,000.00 gross. This was followed by the award of the roofing work to the company Timo Schultz, Imsbach, at a gross tender price of € 27,867.82, which had originally been estimated at € 20,000.00 gross. Finally, the contract for the supply and installation of plastic windows was awarded to the carpentry company Waßner, Winnweiler, at a gross tender price of €127,523.97. The gross cost estimate here was € 105,000.00.

The contract for the planting of the parking lot at the medical center was awarded to the company Moschelland-Baumschulen at a gross tender price of € 24,337.33. The gross cost estimate was € 25,000.00.

Under the next item on the agenda, Mayor Rudolf Jacob was authorized to award the 2025 annual road maintenance contract in the area of VG Winnweiler to the lowest bidder. A restricted invitation to tender has taken place here, the audited results of which are not yet available.

Without further discussion, the municipal council approved the partial update of the land use plan of the municipality of Winnweiler with regard to the development plans "Solarpark Kaiserstraße I" in the municipality of Börrstadt and "Solarpark Kaiserstraße II" in the municipality of Imsbach. Early public participation will be carried out in the form of an open plan with the opportunity to comment on and discuss the plans. The authorities and other public agencies will be involved accordingly. The administration was commissioned to carry out the procedure for public and official participation in accordance with the BauGB.

The municipal council approved the amendment to the shareholder agreement of "Neue Energie Donnersbergkreis GmbH". The municipality is a shareholder with a 5% stake. The company only operates one Solarpak in the local municipality of Alsenz. In order to streamline processes, the shareholder agreement is to be amended so that a supervisory board is no longer required in future.

The mayor also submitted the annual report that no contracts were concluded by the association municipality with council or committee members or employees in 2024 that went beyond ongoing administrative business, service and employment contracts. He also reported that two residents' meetings had been held with the participation of the association municipality.

This was followed by a non-public part in which the appointment of a 1st deputy plant manager and the appointment of a plant manager and a higher grouping were approved.
