Arbitration Office
The office of the arbitrator is staffed as required. There are no fixed office hours. You can make an appointment for a personal meeting at any time.
The arbitration district covers the entire area of the municipality of Winnweiler.
Tasks of the arbitrator
Civil dispute resolution
The arbitrator mediates in disputes:
- on claims under neighboring rights (provided there is no commercial impact)
- on claims for violations of personal honor that were not committed in the press or on the radio
Note:
Legal action in these cases is only admissible after the arbitrator as conciliator has attempted to settle the dispute by mutual agreement.
Criminal dispute resolution (attempt at conciliation)
The arbitrator is responsible for attempts at conciliation in the following criminal cases:
- Trespassing
- Insult
- Violation of the secrecy of correspondence
- Bodily injury
- Threat
- Damage to property
Exceptions
The activity of the arbitrator does not apply to:
- Actions pursuant to Sections 323, 324 and 328 ZPO, counterclaims and actions to be brought within statutory or court deadlines
- Disputes in family matters and retrial proceedings
- Claims in documentary or bill of exchange proceedings
- Proceedings that are already dealt with in the dunning procedure
- Actions for enforcement measures, in particular pursuant to Book 8 ZPO
- Applications according to § 404 StPO
- Actions with mandatory preliminary proceedings prescribed by law
